Terms & Conditions of Sale
1. GENERAL

1.1 The Terms and Conditions of business set out below cancel and supersede all previous issues. These Terms and Conditions of business shall be governed by the Law of England and parties agree to submit to the jurisdiction of the Courts of England & Wales.

1.2 The "Company" means Arts, Corporate & Entertainment Productions Ltd trading as Cigars Unlimited. A Private Limited company registered in the U.K. No. 2807113. The "Customer" means any Company, firm or individual who receives a price list from and/or places an order with the Company.

2. CIGARS

2.1 Cigars are only available to smokers aged 18 years or over, resident in the U.K.

3. PAYMENT

3.1 Payment is not taken for Goods until they are despatched. All Goods sold include VAT at the current rate

4. PRICES

4.1 All prices for Goods, whether listed or not, discretionary discounts, delivery charges and Value Added Tax are subject to change without notice.

4.2 All Goods and products are subject to availability. We reserve the right to alter the specification of goods supplied by us at any time without prior notice.

4.3 All Goods are sold subject to the prices prevailing at the time of purchase. In the event that either the chosen product is unavailable or the price has changed you will be informed before your order is processed.

5. DELIVERY - see our terms and conditions as specifically outined in "Delivery" section.

5.1 Before we despatch your order we will confirm the delivery details by Email. If the goods you require are out of stock we will advise you of the anticipated delivery dates. Before ordering Online please ensure that you decide which of the two following postal options you prefer: Standard or Special Delivery.

5.2 The cost of the delivery of the item you have bought is added to your shopping basket at the point of sale (checkout) and includes Vat.

5.3 If you order several items which are to be sent to the same address we will charge you according to their volumetric size or weight. Whilst we will acknowledge your order we will not wait for confirmation of the postage charge, automatically charging your credit card appropriately.

5.4 Please call Customer Service should you be undecided as to the correct delivery option before you complete your purchase. NOTE: We only despatch goods to the billing address of the card holder which will require a signature upon receipt. Please ensure that someone is at the address to sign for the order.

5.5 Standard Delivery of all U.K orders is by means of Royal Mail Recorded Delivery. Should your purchase weigh more than 2 kilogrammes we reserve the right to send it by Parcel Force Standard Service. Whilst we will acknowledge your order we will not wait for confirmation of the postage charge, automatically charging your credit card appropriately.

5.6 Special Delivery. If you require a guaranteed next day delivery anywhere in the United Kingdom before 1 pm the following day goods can be sent by means of Royal Mail Special Delivery. We have to receive your order before 2 pm for delivery the following day. This service includes a limited insurance if the item is valuable. Whilst we will acknowledge your order we will not wait for confirmation of the postage charge, automatically charging your credit card appropriately. NOTE: This service is only valid Monday to Friday - there is no garantee for Saturday delivery.

5.7 International Orders are usually despatched using Royal Mail International Signed For or in the case of heavier items Parcel Force Worldwide. This can take between 5-7 working days at a flat fee according to weight and value.

5.8 We accept no responsibility for Cuban Cigars despatched to the USA by Standard Air Mail. See USA Delivery for details.

However we do offer a GUARANTEED NEXT DAY PREMIUM DELIVERY SERVICE at a small premium over standard airmail prices. Again as with all our postal services we will acknowledge your order but will not wait for your confirmation debiting your credit card accordingly.

5.9 The goods shall be deemed to have been delivered to the Customer when delivered to a person appearing to have the authority to sign for them at the destination to which they have been consigned.

5.10 Any despatch date or delivery time specified is only an estimate and the Company shall not be liable for any economic loss or damage whatsoever incurred by the Customer as a result of a failure of the Company or its agents to deliver the said goods.

5.11 The Company shall not be liable for any delay or failure to deliver Goods resulting wholly or in part from civil commotion, accidents, riots, strikes, lockouts, fire, flooding, Acts of God, shortage of materials, government action or regulation. Any such failure shall not affect the obligation of the customer to pay for any goods already delivered.

5.12 The Company reserves the right to deliver the Goods by instalments.

5.13 Should you have any queries as to the cost of delivery of a specific item / s or require further information related to the delivery of goods please call us before you confirm your order Online.

6. RETURNS

6.1 If Goods have not been received within fourteen days from the date of despatch, detailed written notification must be made directly to us. Furthermore, no claim for damage or pilferage can be entertained unless notice of such is given within 3 days of the receipt of the goods.

6.2 If the said Goods were either damaged or faulty upon delivery we will replace them.

IMPORTANT : Please call Customer Service to inform us and retain the original packaging for our inspection to validate your claim. Both the product and the original packaging should be returned within 10 days of receipt along with a written claim stating exactly why the item has been returned. We will not replace either a damaged or faulty item until it has been returned.

6.3 We endorse a no quibble policy should you not be happy with the product or goods that you have purchased. Within 7 days of receipt of the said item/s we agree to either replace the goods with a same cost alternative. Or offer a refund ( less the cost of the original postage ) provided that the item or cigars are returned to us in good condition and are fit for sale. All you pay is the return postage.

6.4 Your credit card will be credited with the appropriate amount ( as per above ) upon receipt of the goods should you not wish for a replacement or alternative.

7. PROPERTY TITLE

7.1 Until the buyer has paid in full the purchase price and any interest and any other charges due in respect of the goods, the legal and beneficial ownership of the goods shall remain with the Company. If the buyer is in breach of any of these Terms and Conditions the Company shall be entitled (in addition to all other rights) to recover possession of the said goods and is hereby authorised to enter the buyers premises for this purpose.

7.2 If the buyer sells any of the goods before paying in full for such goods, the buyer shall hold the proceeds of the sale in trust for the Company and such proceeds of sale shall be placed in a separate account in the name of the Company.

7.3 The customer may not assign, subcontract or in any way dispose of its rights and obligations under this or any other contract with the Company.

8. CREDIT CARD SECURITY

8.1 We constantly strive to ensure our customers are afforded the latest Online security measures. To this effect we have upgraded our Checkout procedure to encompass the latest "Verified by Visa" and "Mastercard Secure Code" provided that YOU HAVE FIRST REGISTERED WITH YOUR BANK TO ACQUIRE A SECURITY PIN CODE.

Even if you have not availed yourself of this facility all your credit card details remain totally safe and recorded by means of 128 bit encryption. They are not held in any form of clear text. So you can buy Online with complete confidence, your purchase and credit card details totally secure.

9. PRIVACY

9.1 When you register Online with CigarsUnlimited we treat any information you may choose to disclose as entirely private. We do not share or part with any information whatsoever to third parties. Cookies are used on our WebSite to simply keep track of the contents of your shopping cart and purchase details or when you select 'Remember Me'.

10. VAT REFUNDS

10.1 An Administration Charge of £10.00 is levied on each and every order or sale processed for sales up to a value of £100.00 under the U.K.'s Retail Export Scheme offering Vat refunds for overseas visitors to the United Kingdom. The charge for purchases between £100 and £500 is £15.00. Sales in excess of £500.00 amounts to £20.00. All prices on our WebSite are shown excluding Vat @ 17.5% to assist Non European Union customers who order goods Online. The Vat element of the purchase is deducted automatically at Checkout. This Administration Charge specifically applies to retail customers buying "in person" direct from our shop.
